I. Duty and composition
The Higher Council of Justice is the organ of representation, government and administration of the judicial organisation, which watches over the independence and proper functioning of justice. It appoints the Magistrates, Judges and Clerks of the Court and exercises the disciplinary function; and since 1 July 2004 has also appointed the officials and agents of the Administration of Justice.
It also appoints, from among the Magistrates and Judges who have been proposed, the Presidents of the Magistrates' Court, the Criminal Court, and the High Court of Justice.
The Higher Council of Justice is composed of five members appointed among Andorrans aged over twenty-five years and conversant with the Administration of Justice, one by each co-prince, one by the speaker (síndic general), one by the Prime Minister (cap de govern) and one elected by the judges and magistrates.
Their mandate is for 6 years and they cannot be re-elected more than once consecutively.
The member appointed by the Speaker is automatically President of the Higher Council of Justice and its representative.
A vice-president and a member-secretary are elected from among the members of the Council
